2008: More Notable Settlements

Here are some of the cases handled by the lawyers of Marsh, Rickard & Bryan that helped to make the year 2008 memorable:
David Marsh, Rip Andrews, and Jeff Rickard settled a lawsuit against a major tire manufacturer; this is one of several tire cases the firm has successfully handled over the past several years. The case grew out of a head-on collision in Marion County in which four people, including the defendant driver, died and a child was seriously injured. We argued that the wreck was caused by the failure of the tire on defendant driver's van. According to Rip, the case involved several hard-fought discovery battles. Nat Bryan also did significant work on this case.
Earlier this year, Nat and Derrick Mills resolved a claim against another tire manufacturer -- this time the tire that failed was on an ambulance and the tire failure resulted in a loss of control and a rollover of the ambulance. Nat and Derrick represented the family of a woman being transported to the hospital who was killed as a reslut of injuries suffered in the accident. Previously, the lawyers settled the rollover claims in the lawsuit.
David, Nat and Derrick resolved a lawsuit on behalf of a man who was severely injured when a shipment of unpackaged glass doors shifted and fell as he was unloading them from a box trailer. When this happened, the plaintiff was a 34-year-old dock worker, married with young children at home. The C-7 burst fracture he suffered left him permanently paralyzed from the waist down. The case involved claims that the manufacturer failed to package the glass doors in a manner that was reasonably safe for shipping and loading. There was expert testimony on proper packaging methods. The manufacturer blamed the plaintiff for the accident. At mediation, Susan Silvernail told the plaintiff's story through pictures and video interviews.
Jeff and David settled a case stemming from an automobile-truck collision that occurred in 2005 in Colbert County. The accident happened when a cement truck ran a stop sign and struck the car in which our clients--twin sisters--were traveling. Tragically, one of the young women was killed in the collision. The other received injuries and witnessed the horrific death of her twin. Jeff and David filed a wrongful death case for the family and a personal injury case for the surviving twin that included a "zone of danger" claim. One of the controversies in the case was the effect of prescription drugs taken by the driver of the cement truck at the time of the wreck.
Mike Beard and David resolved a lawsuit on behalf of a Limestone County teacher who was rendered quadriplegic as the result of a car wreck. The driver of the car that struck the plaintiff's SUV was drunk. Mike also pursued a products liability case against the manufacturer of the plaintiff's SUV. At mediation, Susan presented the story of the plaintiff's life before and after his catastrophic injuries through pictures and video interviews with family, friends, caretakers and former co-workers.
