Why Choose Marsh | Rickard | Bryan for Motorcycle Accident Cases in Homewood, AL?

Attorneys With Real Trial Experience

David Marsh co-founded this firm more than 30 years ago and has practiced personal injury law in Alabama for over four decades. Jeff Rickard, also a co-founder, has more than 30 years of practice and has earned recognition from Super Lawyers and the National Trial Lawyers. Jeff served as president of the Alabama Association for Justice. Together, they’ve built a firm with a reputation for taking on serious injury cases and preparing every one as if it will go to trial.

Motorcycle injury claims require a specific kind of attention. Adjusters often try to blame the rider. They assume the motorcyclist was speeding, weaving, or riding recklessly. That kind of bias can influence settlement offers and even jury perceptions. Our firm knows how to counter those assumptions with physical evidence, witness testimony, accident reconstruction analysis, and a factual presentation of how the crash occurred.

Results That Reflect Our Commitment

Across all practice areas, our personal injury lawyers in Homewood, AL have recovered millions of dollars for clients in verdicts and settlements throughout Alabama. We have handled cases involving catastrophic collision injuries, wrongful death arising from vehicle accidents, and claims against commercial vehicle operators. Rip Andrews and Derrick Mills are among the firm’s partners who actively handle motor vehicle injury cases, each with over 20 years of practice.

Free Case Evaluation and No Upfront Fees

Your consultation costs nothing, and you will never owe us a fee unless we secure compensation for you. That is how we have always worked with injury clients, and it means you can focus on getting better while we focus on your case.

Types of Motorcycle Accident Cases We Handle in Homewood

Motorcycle crashes happen for a variety of reasons, and each type presents its own set of legal and factual issues. These are the kinds of motorcycle accident claims we regularly take on.

  • Left-turn collisions. This is one of the most common motorcycle crash scenarios. A car or truck turns left across an oncoming rider’s path. Drivers frequently fail to see motorcyclists in these situations, even when the rider has the right of way.
  • Rear-end crashes. A motorcycle that is stopped at a light or intersection has almost no protection when a distracted or inattentive driver strikes from behind. The injuries from these impacts can be catastrophic.
  • Lane-splitting and lane-change accidents. When a driver changes lanes without checking blind spots, motorcyclists are often the ones who pay the price. Unlike larger vehicles, motorcycles can disappear into a car’s blind zone entirely.
  • Car accidents. Any crash between a passenger vehicle and a motorcycle carries the potential for devastating injuries. We handle these claims whether the wreck happened on a city street, a county road, or an interstate on-ramp near Homewood.
  • Drunk driver crashes. When an intoxicated driver strikes a motorcyclist, the rider may pursue both a negligence claim and potentially a dram shop claim against the bar or restaurant that served the impaired driver.
  • Road hazard and defect accidents. Potholes, loose gravel, missing signage, and poor road maintenance are far more dangerous for motorcyclists than for four-wheeled vehicles. When a government entity or contractor’s negligence contributed to the crash, a premises liability claim may apply.
  • Defective motorcycle parts. A faulty tire, brake failure, or throttle defect can cause a crash without any driver negligence being involved. These are product liability cases, and they require a different legal approach than a standard collision claim.

Alabama Legal Requirements for Motorcycle Accident Claims

Alabama’s legal framework for motorcycle injury cases mirrors much of its broader personal injury law, but there are a few points riders need to know.

The statute of limitations under Alabama Code § 6-2-38 gives you two years from the date of your accident to file a lawsuit. This deadline is absolute. If you miss it, you lose your right to pursue compensation regardless of how strong your case might be.

Alabama follows a contributory negligence standard, which is among the strictest in the country. If the defendant or their insurance company can show that you were even partially at fault for the crash, your claim could be denied entirely. For motorcyclists, this is a particular concern. Defense attorneys will scrutinize everything: your speed, your lane position, whether you were wearing a helmet, whether you signaled, etc.

According to NHTSA safety data, the fatality rate for motorcyclists per vehicle mile traveled is roughly 29 times higher than that of passenger car occupants. That disparity underscores why motorcycle injury claims typically involve more serious medical injuries, longer treatment timelines, and higher financial stakes than the average car accident case.

Alabama also requires motorcycle operators to carry minimum liability insurance, just like car drivers. But minimum coverage amounts are rarely sufficient when a rider suffers catastrophic injuries. If the at-fault driver’s policy limits are inadequate, your own underinsured motorist coverage may be the difference between full recovery and a shortfall.

What Damages Are Recoverable After a Motorcycle Accident in Homewood?

The damages available in a motorcycle wreck case in Alabama are substantial when the injuries are severe.

Economic damages include measurable financial loss. Emergency medical transport, hospital stays, surgeries, physical therapy, medications, assistive devices, and home modifications if your injuries are permanent. Lost income during recovery is part of this calculation. So is the loss of future earning capacity if you cannot return to the same kind of work. According to the CDC’s injury cost data, the lifetime cost of treating a traumatic brain injury can exceed $1 million. Spinal cord injuries are even higher.

Non-economic damages cover the pain and emotional toll of your injuries. Physical suffering, anxiety, depression, scarring, loss of mobility, and the inability to participate in activities you valued before the accident. Alabama does not cap compensatory damages in motorcycle accident cases. The amount is determined by the facts and by what a jury considers fair.

Punitive damages may be pursued when the other driver’s behavior was reckless or wanton. If the driver who hit you was intoxicated, street racing, or fleeing from police, for example, Alabama Code § 6-11-21 allows for punitive damages, which are generally capped at three times compensatory damages or $1.5 million, whichever amount is greater. This category of damages is about accountability, not just compensation.

Motorcycle crash victims need to begin documenting their damages immediately. Medical records, photographs of injuries at every stage of healing, wage verification from your employer, and statements from treating physicians all strengthen the case. The more thorough the documentation, the harder it is for an insurer to undervalue your claim.

"They...brought justice to my family through a multi-million dollar verdict."
These lawyers took a complicated issue, revealed the truth in a way 12 jurors unfamiliar with the topic could understand, and brought justice to my family through a multi-million dollar verdict. They were able to relate my “invisible” medical condition to the jury better than I can to my own friends. And because of that, the jury hugged me and cried with me when it was all over. That meant more to me than any amount of money.
